By accessing or using HOA Solution, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, as well as the Privacy Policy and applicable provisions of the Data Privacy Act of 2012 (Republic Act No. 10173).

2. Purpose of the Platform

Online Voting and Elections

Maintenance Requests

Other HOA-related services

3. User Eligibility

Only registered homeowners, authorized occupants, tenants (when approved by the HOA), HOA officers, and authorized administrators may use the platform.

Users must provide accurate and complete information during registration and promptly update any changes to their profile.

4. User Responsibilities

Users agree to:

Provide truthful and accurate information.
Keep login credentials confidential.
Notify the HOA immediately if unauthorized access is suspected.
Use the platform only for lawful and HOA-related purposes.
Respect other homeowners and avoid abusive, defamatory, or inappropriate content.

Users shall not:

Attempt to hack or interfere with the system.
Upload malicious software or viruses.
Use another person's account.
Misrepresent their identity.
Collect or misuse other users' personal information.

5. Online Voting

When online voting is available:

Only eligible homeowners may vote.
Each qualified property is entitled to vote in accordance with the HOA's Election Rules.
Votes submitted through the system are final once confirmed and cannot be modified unless allowed by the Election Committee.
The HOA reserves the right to verify voter eligibility before counting votes.

6. Billing and Payments

Billing information displayed on HOA Solution is for informational purposes.

Official receipts and payment confirmations shall be issued in accordance with the HOA's accounting policies.

Users are responsible for verifying payment details before completing any transaction.

7. Data Privacy

HOA Solution is committed to protecting personal information in accordance with the Data Privacy Act of 2012 (RA 10173).

By using the platform, users consent to the collection, processing, storage, and use of their personal information solely for legitimate HOA operations.

Reasonable administrative, organizational, and technical safeguards are implemented to protect homeowner data.

8. Intellectual Property

All software, logos, trademarks, content, graphics, and documents available on HOA Solution remain the property of HOA Solution, Zeta Heights, or their respective owners.

No content may be copied, reproduced, distributed, or modified without prior written permission.

9. System Availability

While HOA Solution strives to maintain continuous service, temporary interruptions may occur due to:

System maintenance
Internet connectivity
Security updates
Force majeure events
Technical failures beyond reasonable control

The HOA and HOA Solution shall not be liable for temporary service interruptions.

10. Limitation of Liability

HOA Solution serves as a digital management platform.

The HOA remains responsible for its governance decisions, financial policies, election procedures, and community rules.

HOA Solution shall not be liable for losses resulting from user negligence, unauthorized account access caused by compromised credentials, internet outages, or events beyond its reasonable control.

11. Account Suspension

The HOA reserves the right to suspend or terminate any account that:

Violates these Terms and Conditions.
Provides false information.
Misuses the platform.
Engages in fraudulent or illegal activities.
Threatens the security or integrity of the system.

12. Amendments

The HOA or HOA Solution may update these Terms and Conditions from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of the Philippines, including:

Republic Act No. 10173 (Data Privacy Act of 2012)
